Why is a Local Environmental Plan important?
Local Environmental Plans (LEPs) guide planning decisions and manage the way land is used within a local government area. LEPs are used to zone land for a range of uses such as for housing, commercial and industrial development, open space, rural development and other uses.
LEPs are the main planning tool to shape the future of communities and ensure local development is done appropriately and in an environmentally sensitive manner.

What Local Environmental Plans apply in Eurobodalla Shire?
Eurobodalla Local Environmental Plan 2012

Check what you can do/build on your land
Land use tables in the LEPs outline what development is permitted without consent, what uses need development consent and what is prohibited.

Exempt and complying development
Some uses or development may be exempt from needing development consent, and some may be able to be undertaken with a Complying Development Certificate (CDC).
What is a planning proposal?
A planning proposal is a document that explains the detail and intended effect of a proposed LEP or a proposed amendment to an existing LEP. The planning proposal sets out the reasons for making that plan and the potential social, economic and environmental impacts of the proposal.
The preparation of a planning proposal is the first step in preparing or amending an LEP. Throughout the course of preparing the proposed LEP, the planning proposal itself may evolve. This is especially the case for complex proposals. Planning proposals are exhibited for community input before any final decisions are made on the plans.

Implementation of Rural Lands Strategy and other matters
On 12 July 2016 Council endorsed a planning proposal to implement the recommendations of the Rural Lands Strategy and to make other amendments to the Eurobodalla Local Environmental Plan 2012.
A Gateway Determination from the Minister for Planning was issued to Council on 31 October 2017.

Reclassification and rezoning of land at Narooma
On 9 May 2017, Council endorsed a planning proposal to reclassify and rezone part of Lot 23 DP 865887 on Flying Fox Road/Rainforest Parkway, Narooma. A public hearing on this matter was held on 16 November 2017. Council endorsed a final planning proposal on 12 December 2017.
Housekeeping LEP Amendments
- On 9 May 2017, Council endorsed a planning proposal to make a number of minor housekeeping and other amendments to ELEP 2012. Public exhibition of this proposal closed on 2 November 2017. Following consideration of submissions received, Council endorsed a final planning proposal on 12 December 2017.
Flood mapping and related amendments
On 8 August 2017, Council endorsed a planning proposal to include flood mapping in the ELEP 2012, to rezone certain flood prone land from E2 to an appropriate zone and to make related amendments. A Gateway Determination on this planning proposal was issued on 27 November 2017 and it is now on public exhibition until 2 February 2018.
3 Brown Close, Moruya Heads
On 12 December 2017, Council endorsed a planning proposal to change the minimum lot size for land at 3 Brown Close, Moruya Heads. Council is currently awaiting the issue of a Gateway Determination before putting this planning proposal on public exhibition.
